In these Terms and Conditions “we, our, us, Soar Equestrian & Country refers to Soar Tackle, Soar Equestrian & Country is apart of Soar Tackle Kegworth.
ACCEPTANCE OF TERMS
You agree that you shall not use the Web site for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the web site in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Web site. You also agree not to compromise the security of the Web site or attempt to gain access to secured areas or sensitive information.
You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.
Soar Tackle reserve the right to change any part of this agreement without notice and your use of the Web site will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.
Soar Tackle has complete discretion to modify or remove any part of this site without warning or liability arising from such action.
2 LIMITATION OF LIABILITY
Soar Tackle will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Web site. Soar Tackle is fully insured which includes product liability and public liability.
All trademarks, trade names, patents, registered designs and any other property rights derived from the esthetics or functionality of the Web site remain the property of their respective owners, and are used on this web site for reference only.
By using the Web site you agree to respect these property rights and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Web site.
The information contained with the Web site is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Web site.
We do not guarantee uninterrupted availability of the Soar Tackle Web site and cannot provide any representation that using the Web site will be error free.
5 OUT OF STOCK ITEMS
Here at Soar Equestrian our staff will try to avoid any disappointment on out of stock items, but on occasions where listed goods are out of stock, we may offer items of similar value or better specification and value to your original choice. If you want the item of choice that is out of stock we will back order this for you, unless advised otherwise. As soon as the purchase is in stock we will contact you to advise delivery.
We endeavour to ensure product availability wherever possible, all products and services are subject to availability and maybe withdrawn at anytime without prior notice.
Soar Equestrian are not responsible for compensating you for any unforeseeable losses you may suffer in relation to goods ordered and if goods are not supplied, deemed faulty, damaged in transit or delayed.
Your statutory rights as a consumer are not affected.
6 FAULTY GOODS
If you think there is a fault with your purchase please contact us so we can help to sort any problems. If there is a fault we will refund the price paid in full and postage as long as the goods are returned in their original packaging, with the receipt and within 14 days of delivery. All products on this website are guaranteed against manufacturing defects for twelve months from the date of purchase unless stated otherwise, this does not apply to faults caused by accident, neglect or misuse.
Manufacturers Defect Found:
· The item(s) will be repaired, replaced or the value of returned item(s) refunded at your discretion.
· If the item(s) are discontinued we will offer a replacement of equal or better specification.
7 UNSUITABLE GOODS
You have the right to return an item or cancel your order with us, in accordance with Consumer Protection (Distance Selling) Regulations. The period in which you have to exercise that right, by law is 14 days from the date of receiving your goods. The unused goods, as sold including any offer/free item(s) received in conjunction with the returned item(s) must be returned, at the customer’s expense, in the original packaging within 14 days of notice to cancel. We will refund you in full including the original postage. Soar Equestrian reserves the right to have the goods inspected by a technician prior to replacement or refund. All perishable items this includes feeds are not covered by the above terms, Unless sent in error. Also see Returns Policy
7a Mechanical goods - inverter generators
These items are covered under the long distance sale of goods act but can only be returned if completely unused with all its original tags in place and with any accessories manuals, paperwork included. Mechanical items have to be shipped dry of all fluids. If any fluids ie oil or fuel has been added in to the item then that item will be classed as used and not in a resalable state. Mechanical items will be fully inspected by a trained technician before any refund may be issued.
7b Mechanical item - inverter generator warranty
Soar Equestrian does not cover the warranty of mechanical goods. These items will be covered by their relevant manufactures warranty scheme. Follow any enclosed warranty registration forms making sure they are filled in and sent off. In the event of a claim you will need to do this through the relevant manufactures customer service line.
7c Items that can only be returned if faulty - Safety equipment Due to safety reasons please bear in mind when making a purchase that we are unable to accept any returns for the following items unless they are faulty. Riding hats and Body protectors. If a riding hat or body protector are suspected to be faulty then they will have to be returned to their appropriate manufacture to be checked and demeaned as being faulty before a replacement is issued.
8 Delivery Problems
Within the UK you can usually expect delivery of your order between 2 and 7 days from the day we receive your order. If you have not received your order after 7 days please contact us. We will make enquiries to Royal Mail or our carrier to confirm loss of the parcel and will send a duplicate parcel to you as soon as possible. Outside the UK please contact us if you have not received your order after 2 weeks. In the unlikely event your order is damaged in transit please contact us immediately. You must not sign for your parcel as received in good condition. Please retain the original package for returning your order. We will arrange for the parcel to be collected and a prompt replacement or refund will be sorted out for you.
If you have arranged/left a note to leave your parcel where you have instructed it is at your own risk if there is nobody to receive the delivery when it is attempted. Any theft, loss or damage to your goods or parcel resulting from this arrangement will not be replaced, refunded or credited.
9 PERISHABLE GOODS
Due to feeds and supplements being perishable goods we can not espect these items for exchange or refund unless sent in error.
10 RETURNS POLICY

Please ensure that the items are in original or secure packaging, where necessary please state the fault and or why your are returning your items. Please enclose proof of purchase i.e. Invoice/Receipt along with your full personal details.
Please obtain a certificate of posting from your post office or courier when you send any time back to us, regretfully we cannot be held responsible for goods whilst in transit.
As set out in the distance selling directive the customer must pay for the return of goods and send them back to us with in 14 day's as set out above. If the goods are faulty we will either replace the goods and refund the cost of your postage back to us, or refund the goods and postage in full. You must provide a copy of the receipt for monies paid for postage.
If the goods are not wanted yon must return the goods as set out above with in 14 day's. We will issue a full refund including the postage to you (this does not include the postage back to us)
All vouchers have a minimum spend of £10 plus Postage & Packaging unless stated otherwise, Vouchers can not be used in conjunction with any other offer, discount or like wise.
12 THIRD PARTIES
The Web site may contain hyperlinks to web sites operated by other parties. We do not control such web sites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such web sites does not imply any endorsement of views, statements or information contained in such web sites.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
14 GOVERNING LAW AND JURISDICTION
This Agreement will be governed by the laws of England and any user of the Web site hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.
Soar Tackle & Soar Equestrian agrees to supply and you agree to purchase goods subject to these terms and conditions, which shall supersede any terms and conditions on any purchase order or document that you submit to Soar Tackle & Soar Equestrian.
These terms and conditions apply and take precedence over all others. All goods remain property of Soar Tackle until full payment has been received. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and each party agrees to submit to the exclusive jurisdiction of the courts of England and Wales.
